Do you guys charge late fee's?

Hey everyone,

I'm having a pretty big headache with a client lately. We have them on a year long contract for web maintenance with monthly payments. Our contract stipulates that if payments are received late we charge a rate of 10% per week.

We have it set so high because our overheads are often charged weekly. If a client is late 1, 2, 3 days we don't even charge this rate. Even if they're late 2 weeks we often don't charge either. But recently we have a client who hasn't paid us since September. They are refusing to pay any of the late fee's because they say they are too high and won't hold up in court. Does anyone have any experience with this?
