I'm sure this gets asked a lot, so i'll keep the long story short. I've worked with this boss for four years, and he's always had issues with delays on payments, but he's always ended up paying me in full.
There were two projects, both finished at the end of December last year. The first project was fully finished, and the second just needed a bit of work and then it'd be ready to launch, and I was waiting on my boss directions on finishing the last project.
Well, from December until a few days ago, I tried multiple times to get in contact with him to finish up project 2, and to get paid for project 1. I texted, emailed, voicemailed, and called, and he ignored all attempts I made to communicate.
He finally hit me up a few days ago. With a giant sob story of how his ex wife and him are going through divorce and she is trying to steal his business, his money, and all his clients. He sais his money is locked up, but he will get paid mid march, and when he does he can pay me. But he said I have another option and that is to finish project 2 (two months later) and he will charge project 2 client, and he will pay me for both project 1 and 2 if this happens. I told him I am not doing anymore work for free, and I don't even trust if he'd stick to that.
So now, i'm not sure what to do. He owes me a bit less then $700. We have no official contracts but plenty of email proof that he was intending to pay, and also all copies of my quotes for the websites and hours i've worked.
Should I go to court? Should I take his sites down and hold them hostage? Because frankly I don't care about his divorce, he had months of time to communicate with me to which I would have been understanding and helpful, but after he ignored me for two months and wants to withhold my pay for ANOTHER month, well, i'm done with him.
